This has been added to the Busch rules regarding drivers not in the race:

Drivers Not Making The Race

If you pick a driver and he doesn't qualify into the race you will be docked 5 points. You will also be docked 5 points if you choose a driver that is not competing in the race. All the drivers attempting to make the race will appear on the race entry list. Even if you pick a driver that shares the car with another driver, you will not receive the picks if the other driver is running the race, so be sure to check before you submit your picks.

EXCEPTIONS: the only way that you will receive the picks of a substitute driver is if any changes happen during or after qualifying. If a driver is unable to qualify, but gets a ride in another car, you will receive his points. If one of of your picks gives up his ride to another driver, you will receive the picks of the substitute driver. If you have both drivers in your picks, you will receive the same points for both picks.

I made it a 5 point penalty because of the situation in the league last year with drivers getting 0 points who are not in the field while you can receive up to 5 penalty points if they are in the field.
